What Is Night Shift Differential?

Night shift differential (NSD) is an additional compensation of not less than 10% of an employee's regular wage for each hour of work performed between 10:00 PM and 6:00 AM. This benefit is mandated by Article 86 of the Labor Code of the Philippines.

NSD Per Hour = Hourly Rate × 10%

For example, if your regular hourly rate is PHP 80.63, your NSD premium is PHP 8.06 per hour — making your total night rate PHP 88.69 per hour.

NSD Combined with Other Premiums

Night shift differential stacks on top of any applicable overtime, rest day, or holiday premium. The 10% NSD is applied to the applicable rate:

Who Is Covered?

All employees in the private sector who perform work between 10:00 PM and 6:00 AM are entitled to night shift differential. This includes:

  • Regular, probationary, contractual, and casual employees
  • Employees on night rotation or graveyard shifts
  • Employees whose work extends past 10:00 PM (only the hours between 10 PM and 6 AM qualify)

Exemptions

  • Government employees (covered by separate civil service rules)
  • Managerial employees
  • Field personnel whose hours cannot be reasonably determined
  • Domestic workers (kasambahay) — governed by RA 10361
  • Workers in retail and service establishments employing not more than 5 workers
